New Jersey Superior Court Blocks Access to Face Book

Monmouth County Superior Court Judge Daniel Waldman denied the defendant's request to access the plaintiff's face book account in order to test the credibility of plaintiff's complaints. The plaintiff argued that her Facebook page was in essence her on line home and communications within that home should not be the subject of discovery. In the case of Krawchuk v Bachman, Judge Waldman ruled that the request was an invasion of privacy and that there were other means to check the credibility of the plaintiff.

It should be noted that other judges across the country have ruled to the contrary. Hopefully other judges will follow the enlightened reasoning of Judge Waldman.
